Terms of service
These terms govern the use of the Pulzeo service. By creating an account, you acknowledge that you have read and accepted them. The service is intended for professionals (B2B).
1. Purpose
These terms of service and sale (the “Terms”) govern the relationship between:
- Ecom Liberty, a company registered in Mauritius, BRN I21008419, with its registered office at Royal Road, Les Terrasses du Barachois, 90901, Tamarin, Mauritius (hereinafter “Pulzeo” or “we”),
- and any natural person acting on behalf of a business entity using the service (hereinafter the “User” or “you”).
Pulzeo is a B2B service for professionals (marketing agencies, freelance digital marketers, advertisers, in-house marketing teams).
2. Definitions
- Service: the Pulzeo web application, accessible from pulzeo.com, its subdomains and the associated APIs.
- Account: the User’s personal area, accessible after authentication.
- Organization: the logical entity to which one or more Accounts belong and which holds the plan.
- Plan: the set of features and contractual limits attached to a subscription level (Individual, Business, Agency). All plans are paid and begin with a 14-day free trial, with no credit card required.
3. Creating an account
An Account is created either by providing a valid email address and a password, or through your Google account (“Sign in with Google”). In either case, account creation requires explicit acceptance of these Terms and of the privacy policy. By creating an Account, you warrant that:
- You are acting in a professional capacity and have the legal capacity to enter into these Terms.
- The information you provide is accurate and kept up to date.
- You will maintain the confidentiality of your sign-in credentials (your Pulzeo password, or your Google credentials if you use “Sign in with Google”) and of access to your Account. You are solely responsible for any activity carried out under your Account.
We reserve the right to suspend or terminate an Account without notice in the event of a clear breach of these Terms, fraud or abusive use of the Service.
4. Description of the Service
Pulzeo lets professional users:
- Connect one or more Google Ads accounts through OAuth 2.0.
- Review how their Google Ads campaigns perform through an aggregated dashboard, including audience analysis and comparison between campaigns.
- Research keywords and view the search volumes and cost estimates provided by Google.
- Receive analyses and optimization recommendations produced by our AI assistant “Zeo” (built on third-party language models), and chat with it.
- Audit their conversion tracking, connect a Google Tag Manager container and publish the suggested fixes to it.
- Create and configure conversion actions directly in their Google Ads account from the Pulzeo interface.
- Apply certain optimization recommendations from the Service to their Google Ads account in one click.
- Generate client reports, manually or automatically, with the option to schedule their delivery to selected recipients.
- (Agency plan) Consolidate several Google Ads accounts in a portfolio view and invite several users, each with a role, to the same organization.
Some of these features write to your Google Ads account or your Google Tag Manager container, always subject to your explicit approval. The liability rules that apply to those operations are set out in Section 11.2.
The Service is provided “as is.” While we commit to providing a quality service, we cannot guarantee 100% availability or the complete absence of errors.
5. Plans, pricing and free trial
Pulzeo offers three paid plans: Individual, Business and Agency. An annual option is available for each plan, with two months free. The prices, features and limits of each plan are set out on the Pricing page. Prices are stated exclusive of any taxes, which apply according to your jurisdiction.
Every new Account receives a 14-day free trial, with no credit card required. The trial has its own usage limits (number of Zeo analyses, conversion audits and reports), which are set out on the Pricing page. At the end of the trial, if you have not subscribed to a paid plan, access to the Service is blocked until you choose one (your data is retained; see Section 7.4).
You can move to a higher plan at any time from your account. Moving to a lower plan (downgrading) requires contacting customer support through our contact form. Our support team will help you, in particular if your usage exceeds the limits of the plan you are moving to.
We reserve the right to change our prices by giving affected users at least 30 days’ notice before the new prices take effect. Any change applies from the next billing cycle and never retroactively.
6. Payment and billing
Payments for paid plans are charged automatically to your card at the start of each billing period (monthly or annual, as you choose). Payments are processed by Stripe Inc., a PCI-DSS certified payment provider. Pulzeo stores no card details.
An invoice is issued for each payment and is available in your account. If a payment fails at renewal, the charge is retried automatically over the following days, and you are then asked to update your payment method. After three unsuccessful attempts, access to the Service and the automations (syncs, analyses, report delivery) are suspended until payment is settled.
7. Term and termination
7.1 Term
The subscription runs for the period you chose (monthly or annual) and renews automatically at the end of each period, unless either party terminates it.
7.2 Termination by the User
You can cancel your subscription at any time from your account, or by writing to us through our contact form. Cancellation takes effect at the end of the current period: partial months are not refunded, except in specific cases (a major outage attributable to Pulzeo).
7.3 Termination by Pulzeo
We may terminate your subscription:
- For convenience, with 30 days’ notice sent by email.
- Without notice in the event of a serious breach of these Terms, fraud, or use of the Service for unlawful purposes or in a way that harms the infrastructure.
7.4 Data retrieval and portability
Upon termination, access to the Service ends immediately: the dashboard, analyses, reports and automations are no longer accessible. Be sure to request your export before you cancel.
Your data is then deleted in stages: the advertising data synced from Google Ads is erased 30 days after access stops, and the whole account is purged after 60 days. Your invoices and your user account (email address and first name) are never deleted by this procedure: the former because of our accounting obligations, the latter so that you can come back.
Under Article 20 of the GDPR (the right to data portability), you can export your data at any time in a structured, commonly used and machine-readable format. Pulzeo provides:
- A complete JSON export (synced metrics, account configuration, generated reports, schedules), on request through our contact form.
An export requested this way is provided within 30 days.
8. User obligations
By using Pulzeo, you agree:
- Not to use the Service for unlawful or fraudulent purposes, or to harm third parties.
- Not to attempt to circumvent the Service’s security or usage-limiting mechanisms (request limits, plan limits, isolation between organizations).
- Not to reverse engineer, mass-scrape the application, or use unauthorized bots.
- To hold the legitimate right to access and share the data of the Google Ads accounts you connect to Pulzeo.
- To check every change the Service suggests before approving it, and to make sure that it suits your objectives and complies with Google’s rules.
- Not to add to automatic report schedules any recipients who have not consented to receive those emails.
9. Personal data
The processing of your personal data is governed by our privacy policy, which forms an integral part of these Terms.
10. Intellectual property
10.1 Pulzeo’s property
The Service, its source code, its interface, its mascot (“Zeo”), its text, illustrations and databases are the exclusive property of Ecom Liberty. Using the Service grants you no ownership over any of it.
10.2 Your data
You retain all rights to the data you provide or that Pulzeo syncs for your account (Google Ads metrics, report content). You grant us only a limited, non-exclusive, non-transferable license to use that data strictly for the purpose of providing the Service.
11. Limitation of liability
11.1 Nature of the Service
Pulzeo is a decision-support and technical automation tool. Pulzeo does not provide advertising consulting services, does not act as an agent or as an agency, and does not run your campaigns for you. The analyses, recommendations and content produced by the “Zeo” assistant are based on third-party language models: they are provided for informational purposes, may contain inaccuracies, and constitute neither personalized professional advice nor any guarantee of results.
11.2 Actions carried out on your third-party accounts
The Service can write to your Google Ads account or your Google Tag Manager container, including creating conversion actions, applying optimization recommendations and publishing tracking fixes. Those operations are never triggered automatically: each one requires your explicit approval in the interface, and Pulzeo merely passes your instruction on to Google’s APIs.
You remain the holder of your accounts at all times and the sole decision-maker as to the changes applied to them. Pulzeo therefore cannot be held liable for the consequences of the changes you approved, including their effect on performance, budgets and ad spend, and their compliance with Google’s rules and policies, or for any action Google may take regarding your account. It is your responsibility to check every change before approving it, and then to monitor its effects.
11.3 Liability cap and exclusions
To the fullest extent permitted by applicable law:
- Pulzeo’s aggregate liability, for all causes combined, is limited to the amounts actually paid by the User over the 12 months preceding the event giving rise to the damage.
- Pulzeo cannot be held liable for indirect or consequential damages, or for loss of opportunity (lost profits, loss of customers, damage to reputation, etc.).
- Pulzeo cannot be held liable for the consequences of a business decision made by the User on the basis of the analyses, recommendations or reports the Service generates.
- Pulzeo cannot be held liable for any unavailability or malfunction attributable to a subprocessor (the Google Ads API, hosting, the database, etc.).
11.4 Scope of these limitations
The limitations and exclusions above do not apply to damages resulting from gross negligence or willful misconduct by Pulzeo or from bodily injury, or, more generally, to cases where applicable law prohibits such a limitation. Nor may they deprive Pulzeo’s essential obligations under these Terms of their substance.
12. Force majeure
Neither party will be held liable for failing to perform its obligations in the event of force majeure as commonly understood (natural disaster, large-scale cyberattack, widespread power outage, government decision, etc.).
13. Changes to these Terms
We may change these Terms to reflect changes in the Service or in our legal obligations. We will notify you of material changes by email at least 30 days before they take effect. Your continued use of the Service after that period constitutes acceptance of the new terms.
14. Miscellaneous
14.1 Severability
If one or more provisions of these Terms are held invalid, or declared invalid under a law or regulation or by a final decision of a competent court, the other provisions remain in full force and effect. The parties will then endeavor, in good faith, to replace the invalidated provision with a valid one that has an equivalent economic effect, or one as close to it as possible.
14.2 Entire agreement
These Terms, together with the privacy policy, the cookie policy, the legal notice and the Security page, constitute the entire agreement between the parties regarding the use of the Service. They supersede any prior agreement, statement, negotiation, undertaking or communication, oral or written, on the same subject matter, except for any special terms expressly agreed in writing between Ecom Liberty and the User.
14.3 Assignment
The User may not assign its rights and obligations under these Terms to a third party without Ecom Liberty’s prior written consent.
Ecom Liberty, however, may freely assign or transfer these Terms, and the rights and obligations attached to them, to a third party, including in connection with a merger, an acquisition, a sale of business, a restructuring or a universal transfer of assets. The User will be informed by email within 30 days after the assignment takes effect. An assignment does not change the terms that apply to the Service or the level of personal data protection.
14.4 No waiver
The fact that one party does not invoke a breach by the other party of any obligation set out in these Terms cannot be interpreted as a waiver of that obligation for the future.
15. Governing law and disputes
These Terms are governed by Mauritian law. Absent an amicable resolution, any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the courts of Mauritius.
For users residing in the European Union, the mandatory provisions of local law (including the GDPR for data protection) remain applicable and prevail over any conflicting clause in these Terms.
Before any litigation, we commit to seeking an amicable solution. To submit a complaint, write to us through our contact form. We will acknowledge receipt within 5 business days.
